1. Acceptance of Terms
- By accessing or using our GoXpot website (the “Platform”), you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Platform.
2. User Accounts
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree not to impersonate another person or create false information in your listings.
3. Profile Listings & Products
- All GoXpot, GoNity listings, profiles, and / or products must comply with our community standards and content guidelines.
- We reserve the right to remove any listing, video link, product or any or all materials deemed inappropriate, misleading, or violating legal policies.
- Locations submitted must be accurate and publicly accessible.
- Products sold or listed through our platform are managed by individual vendors.
- You agree that all materials you upload — including images, product descriptions, branding elements, QR codes (if there are ), video media (in the form of file or link ), and any other content — are provided by you, the vendor and confirm that you either own or have rights to use all such materials and that they do not infringe on any copyrights, trademarks, or intellectual property rights of others.
- Ngagego is not responsible for verifying ownership of submitted content. All legal responsibility remains with the vendor.
- In the event of a dispute regarding materials submitted, Ngagego reserves the right to temporarily disable or remove the content while reviewing the issue.
- Ngagego is not liable for the listing, product availability, quality, pricing, or disputes between users and sellers.
- You grant Ngagego a non-exclusive, royalty-free license to display, promote, and distribute your content within the platform, for marketing and operational purposes.
4. Intellectual Property
- All logos, content, graphics, and branding are owned by GoXpot or their respective creators and may not be used without permission.
- You retain rights to content you upload but grant us a license to display and distribute it as part of our services.
5. Location Services
- We may request access to your GPS location to show relevant nearby content.
- You can decline this access, but some features may not work properly without it.
6. Membership & Plans
- Membership tiers may include content limits (e.g., number of GoXpots) and additional tools.
- Plan upgrades/downgrades are available through your account settings.
- You may upgrade or downgrade your membership at any time. However, please note:
- We do not offer refunds or credits for unused time on your current membership if you change levels mid-cycle.
- If you upgrade, you will be charged the full price of the new plan immediately.
- If you downgrade, you will be billed for the new (lower) plan, but no refund will be issued for the remaining time on your current plan.
7. Prohibited Use
- You agree not to:
- Use the site for illegal activities
- Upload false, spammy, or harmful content
- Attempt to hack, reverse-engineer, or interfere with the platform
8. Termination
- We may suspend or terminate your account for violations of these Terms without notice.
9. Changes to Terms
- We may update these Terms occasionally. Continued use of the platform after changes means you accept the new terms.
10. Platform Availability and Maintenance
- This platform may undergo routine maintenance or encounter unforeseen technical disruptions.
- During these times, partial or full service may be unavailable, with or without prior notice.
- We do not guarantee continuous, error-free access at all times.
11. Limitations of Liability
- We rely on third-party tools and services (e.g., hosting providers, payment processors, geolocation APIs), and do not assume responsibility for outages, errors, or breaches originating from those sources.
- Ngagego and its operators are not liable for any direct, indirect, incidental, or consequential damages resulting from use, misuse, or unavailability of the platform.
- The platform shall be held immune to claims of revenue loss, missed sales, business disruption, data loss, or reputational harm arising from technical issues or third-party service failures.
